THINGS TO DO WHILE WAITING FOR THE ART 
TO PROCESS YOUR PARTNER VISA APPLICATION


Let's go through the necessary procedures while waiting for the ART (Administrative Appeals Tribunal) to process your Partner Visa application with JL Migration & Education. Please note that these are general suggestions for most tribunal cases, and you should contact your migration agent for more detailed and specific advice for your particular case.

  • Ensure you have validly submitted your application to the Tribunal within the specified time frame (In Australia: 21 days, and Outside Australia: 70 days from the date of refusal).
  • The hearing can take from 6 months to a year or more after the submit date, so you must continue to collect evidence of the relationship and keep it carefully.
  • Prepare all necessary explanations/ submission to request the Tribunal to resolve your application on paper (without needing to go to the Tribunal).
  • When the Tribunal considers your application, fill in and return the "Response to hearing invitation" form within 7 days.
  • Before the hearing, check all personal information and ensure you remember all details, timelines of the relationship for the presiding judge's interview.
  • After the hearing, you may ask the Tribunal for further explanation if necessary.
  • Wait for the Tribunal's decision.
  • If the Tribunal remits, your application will be returned to the Department of Home Affairs for further assessment. If you fail, you may consider options such as Ministerial intervention, re-submitting a new application, etc.
