SHOULD WITNESSES BE INVITED TO THE ART
FOR PARTNER VISAS?
Should witnesses be invited to the ART (Administrative Review Tribunal) hearing or not? It will always make the applicant have a headache and hesitate to choose. Be careful with your decisions because the statements of witnesses will be evaluated and affect the Tribunal’s decision.
If the witness is knowledgeable about your relationship and confident in responding correctly to any questions the ART might ask, you should invite them. Especially in cases when you lack or lose evidence, their statements are true to what is in the statement of relationship will always positively support the result of the ART hearing.
Conversely, if the witness does not fully understand the relationship and is not confident in their responses to the ART, you should not invite them because that could negatively impact the Tribunal’s decision if the witness's responses differ from the events in your statement.
Professional Witnesses (e.g., treating doctors) are highly regarded at the ART. Therefore, if you can invite experts related to your case as witnesses, it would be very beneficial.
